Terms of Service

These Terms of Service ("Terms") govern your access to and use of the products, hardware, hosted VoIP services, the website at voipnmore.com, and the customer portal (collectively, the "Services") provided by VoIPnMore ("we", "us", "our"). By creating an account, purchasing hardware, or activating a phone line, you agree to these Terms. If you do not agree, do not use the Services. This page is maintained by VoIPnMore and reflects our current practices; it is not an independent certification.
1. Eligibility & accounts
You must be at least 18 years old and legally able to enter into a contract. You are responsible for keeping your account credentials, portal PIN, SIP passwords, and API keys confidential and for all activity under your account. Notify us immediately of any suspected unauthorized use.
2. The Services
- Hosted VoIP & PBX: SIP trunks, DIDs, extensions, voicemail, SMS, and related telephony features delivered over the public Internet.
- Hardware: IP phones, ATAs, gateways, and accessories, sold new unless clearly marked otherwise.
- Portal: A self-serve dashboard to manage numbers, sub-accounts, CDR, billing, and support tickets.
3. 911 / E911 limitations (IMPORTANT)
VoIP-based 911 service differs from traditional wireline 911. Emergency calls may not connect if your Internet, power, device, or account is unavailable, if you dial from a location other than the registered service address, or if your account is suspended. You agree to:
- Register and keep current a valid civic address for every DID capable of dialing 911.
- Inform all users of the line (employees, family, visitors) of these limitations.
- Maintain an alternate means of contacting emergency services (mobile phone or landline).
4. Acceptable use
You will not, and will not permit anyone using your account to:
- Transmit unlawful, harassing, defamatory, or fraudulent content.
- Send unsolicited bulk voice or SMS traffic, spoof caller ID unlawfully, or violate CRTC, CASL, TCPA, or STIR/SHAKEN requirements.
- Auto-dial, robocall, or run traffic-pumping / short-duration abuse patterns.
- Resell or re-brand the Services without a written reseller agreement with us.
- Interfere with, probe, or attempt to gain unauthorized access to the Services or our network.
We may suspend or terminate any account or line, with or without notice, to protect the network, comply with law enforcement, or address fraud, chargebacks, or acceptable-use violations.
5. Fair use on unlimited plans
Plans marketed as "unlimited" are for normal business or residential use. Sustained traffic patterns that resemble call centres, dialers, broadcasting, or wholesale termination may be re-rated to per-minute pricing or moved to a metered plan.
6. Fees, taxes, and billing
- Recurring service fees are billed monthly in advance; usage (long distance, SMS, DID overages) is billed in arrears.
- All prices are in Canadian dollars (CAD) unless otherwise stated and exclude applicable taxes and regulatory fees (GST/HST/PST/QST, 911 fees, CRTC contribution).
- You authorize us to charge your saved payment method for all amounts due. Declined payments may result in suspension after 5 days and account termination after 30 days.
- Chargebacks initiated without first contacting our support team may be treated as a breach of these Terms.
7. Hardware sales, shipping & returns
- Title and risk of loss pass on delivery to the carrier. Manufacturer warranties apply as marked on each product page.
- Unopened hardware may be returned within 14 days for a refund less a 15% restocking fee; opened hardware is exchange-only for defects.
- Defective units are handled by manufacturer RMA; we facilitate the process at no charge during the warranty period.
- Shipping estimates are not guarantees. We are not liable for carrier delays.
8. Number portability
You may port eligible numbers to and from VoIPnMore subject to Canadian portability rules and the losing carrier's cooperation. Port-out requests are honoured without penalty; any outstanding balances remain due. You are responsible for the accuracy of the port request and for maintaining service with the losing carrier until the port completes.
9. Service levels & availability
We target 99.99% carrier uptime measured monthly excluding scheduled maintenance, force majeure, customer equipment or Internet failures, and third-party outages. Service-affecting incidents are posted to our status page. Credits, if any, are described in your specific service order or master service agreement.
10. Third-party services
The Services integrate third parties including voip.ms (upstream carrier), Square (payments), and Vapi (voice agents). Your use of features that depend on those services is also subject to their terms. We do not guarantee the continuous availability of any third-party feature.
11. Intellectual property
We retain all rights, title, and interest in the Services, our brand, and the portal software. You retain ownership of the content you upload (voicemail greetings, IVR audio, contact lists) and grant us a limited licence to host and process it solely to provide the Services.
12. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICES IS LIMITED TO THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST BUSINESS, WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY.
14. Indemnity
You will defend, indemnify, and hold us harmless from any claim arising out of your use of the Services, your content, your violation of these Terms, or your violation of applicable law (including telemarketing, anti-spam, and privacy laws).
15. Termination
Either party may terminate a month-to-month service on 30 days' notice. We may terminate immediately for non-payment, fraud, abuse, or breach of these Terms. Upon termination, your right to use the Services ends; you remain liable for fees accrued up to the termination date.
16. Governing law & disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. The courts located in Toronto, Ontario have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court.
17. Changes
We may update these Terms. Material changes will be posted here with an updated date and, where required by law, communicated by email. Continued use after the effective date constitutes acceptance.
